ANTHONY S. VITAGLIANO

Anthony S. Vitagliano is a partner at Zelms Erlich Lenkov & Mack, specializing in accountant, attorney, D&O, employment practices liability defense, and appellate matters. Mr. Vitagliano, a former CPA with a Big Four accounting firm and former section chief counsel with the Arizona Attorney General's Office, brings his past extensive experience in corporate transactions and litigation (including mergers and acquisitions; employment, labor and ERISA matters; joint ventures, strategic alliances and international agreements; healthcare and Medicare fraud and abuse; intellectual property and technology matters; financings and lender liability; and general corporate, commercial, employment and professional negligence litigation) to every engagement.

In more than 30 years of practice, Mr. Vitagliano has served as both in-house general counsel and outside counsel for high-tech startups, IPO candidates, public companies, healthcare entities, and international conglomerates. He has represented emerging tech companies in mergers and acquisitions, litigation, contractual matters, licensing arrangements, and capital market transactions, as well as corporate formation, governance and compliance, and regulatory oversight. He has also represented individuals and entities of all types, both as plaintiffs and defendants, in varied negotiations, transactions, litigation, appeals, dispute resolutions and counseling's.

Prior to joining Zelms Erlich Lenkov & Mack, Mr. Vitagliano was a partner at the Phoenix office of Manning & Kass, as well as holding various senior legal and management positions, including: senior vice president, general counsel and head of human resources of a public company; general counsel of an optical startup; vice president and assistant general counsel of an international manufacturing and technology conglomerate; chief operating officer of a startup software business; section chief counsel of the Arizona Attorney General's Office; member of an international law firm and a CPA with a Big Four accounting firm. Mr. Vitagliano’s experience in management, accounting, human resources and law, provides extensive and broad-based knowledge to every engagement.

Mr. Vitagliano is a member of the Arizona State Bar, and is admitted to practice before the United States District Court for the District of Arizona, United States Court of Appeals for the Ninth Circuit, United States Supreme Court, and all Arizona State Courts. He is a certified Senior Professional in Human Resources (SPHR) and is certified in mediation by the Straus Institute for Dispute Resolution, Pepperdine University School of Law.

Mr. Vitagliano received his BS from State University of New York at Buffalo, summa cum laude, and his JD from University of Illinois at Urbana-Champaign, College of Law, magna cum laude, Order of the Coif. While in law school, he served as a Law Review editor. Mr. Vitagliano is also a graduate of the Thunderbird American Graduate School of International Management, Global Telecommunications Management Program; and the Princeton University, AT&T Manufacturing Leadership Program.
